Terms & Conditions for Sellers

1. Introduction & Definitions

These terms and conditions (“Agreement”) govern your use of the platform for listing vehicles for sale. “We,” “us,” or “our” refers to Four Wheel Deals (Pty) Ltd (Registration No. 2025/XXXXXX/07). By listing a vehicle on our platform, you confirm that you have read, understood, and agreed to be bound by this Agreement.

2. Listing & Accuracy

You warrant that all information provided in your listing, including but not limited to mileage, condition, service history, and ownership, is true, accurate, and complete. Misrepresentation may result in removal of your listing, cancellation of any sale, and permanent suspension of your account. You must be the legal owner of the vehicle or have valid authority to sell it.

3. Offers & Acceptance

• Offers are not binding unless and until expressly accepted by you.
• Once accepted, a legally binding agreement is created between you and the buyer, subject to payment clearing.
• Buyers are expected to complete payment and collection within 24–48 hours of acceptance.
• You agree to complete all required transfer paperwork and deliver the vehicle in the condition described.

4. Title, Payments & Transfer

• You remain the lawful owner of the vehicle until full payment has cleared in your bank account.
• We accept no liability if you release the vehicle or documentation before full payment is confirmed.
• You agree to complete the transfer of ownership within 48 hours of payment confirmation, including RC1/NATIS and service books, subject to agreement with the buyer.

5. No Guarantee of Sale

We do not guarantee that your vehicle will sell. Four Wheel Deals (Pty) Ltd is not liable if no offers are received. Offers automatically expire if not accepted within 7 days.

6. Limitation of Liability

Four Wheel Deals (Pty) Ltd acts solely as an online facilitator and is not a party to any sale agreement. We accept no responsibility for failed payments, fraudulent buyers, or disputes between you and a buyer. We do not guarantee sale value, buyer conduct, or condition of the vehicle.

7. Privacy & POPIA

By using our platform, you consent to the processing of your personal information in accordance with the Privacy Policy and the Protection of Personal Information Act, 2013. You may receive communications from us or potential buyers relating to your listing.

8. Governing Law & Disputes

This Agreement is governed by the laws of the Republic of South Africa. Any disputes should first be referred to the Motor Industry Ombudsman of South Africa (MIOSA) for resolution.
